Oral Argument Preview: October 23

The Court will hear oral argument in three cases on Wednesday the 23rd. The archived oral argument will be available to watch here.

Davis v. State

A man convicted of a 1996 rape is appealing the Court of Appeals decision that, while the statute of limitations had run on the prosecution, he used the wrong legal mechanism to challenge his pre-indictment detention.


Clark v. State

Ineffective assistance of counsel case, arguing defense counsel should have the victim's prior felony convictions in support of the defendant's self-defense argument.


McCluskey v. State

A man convicted of shooting and killing his wife is appealing his murder conviction, arguing he shot her by mistake and the trial court should have instructed the jury about the lesser included offenses  of reckless conduct and involuntary manslaughter.
